Replacement dwelling consented in the Green Belt
Optimis Consulting has successfully secured planning permission for a replacement dwelling in Aspley Guise (Central Bedfordshire). The property is within the Green Belt but outside of the infill only boundary that surrounds parts of Aspley Guise.
At late stage in the application process, the Case Officer raised concerns about the scale/height and width of the replacement dwelling with a view to refuse the application. The LPA however failed to recognise that a number of comparable proposals in the immediate locality had been approved by the Council or allowed at appeal in previous years.
The proposed scheme, relevant local caselaw and the dwelling’s fall-back position through PD Rights were subsequently discussed in a meeting with the Case Officer, convincing the LPA to change their position and resulting in the Council granting consent under delegated powers for the replacement dwelling.
