Pop-up Outdoor Structures Permitted Development – A temporary saving grace for the hospitality sector?

Class BB, the new permitted development right allowing moveable structures within the curtilage for pubs, bars, restaurants and historic visitor attractions, came into effect on Monday 16th April 2021.

Only two caveats apply which are that the right does not apply within the curtilage of a scheduled monument or if the moveable structure is for the display of an advertisement.

This temporary right intends to support the hospitality sector as the economy re-opens through the opportunity to increase outdoor seating, as well as reducing administrative cost and time spent processing planning applications.
Given the changeable weather, the UK usually experiences in April and May this may just be a saving grace to businesses with outdoor space who want to keep customers dry during those unexpected showers.

The right is set to expire on 1st January 2022 by which time all structures must have been removed, though we suspect this will be dependent on how the pandemic continues to evolve
