Topical issues in the planning system: Autumn Planning Law Seminar
Members of our planning team attended Howes Percival Autumn Planning Law Seminar on the 14th of October. The session covered a range of topical issues within the current planning system and provided a valuable insight into some of the emerging prospects within the upcoming Planning and Infrastructure Bill.
One key discussion focused on Section 106 agreements and in particular the requirement for Local Planning Authorities (LPAs) to publish the relevant planning obligation on the portal prior to issuing a decision, of which recent court rulings have reinforced. Whilst there is no statutory timeframe for the period in which such documents must be made public, doing so provides important opportunity for potential interested parties to provide comment. This is done so in the interests of transparency in the decision-making process and helps mitigate the risk of subsequent legal challenges that may otherwise put a planning consent at risk.
